that's pretty funny! cause a buddy of mine has one as well and called the cops to find out about the legalaties of driving it on the road and he was told that it is 100% LEGAL to drive on the road. no insurance, no license, and no helmut. i have heard in the past that anything 49cc and under doesn't require a license. don't know if that's true or not. as for DOT numbers on the tires... do bicycle tires have DOT numbers? i've never looked. if they don't then i'd say you could get a ticket for driving that on the street as well. if the law enforcement wants to hand out tickets fairly that it is.

All motorized vehicles must be licensed to drive on the road. Pocketbikes are simply not licenseable; there are too many reasons to list why they will never be legal to ride on the road.
DOT tires are required on motorized vehicles that will be traveling on public roads. Bicycles don't qualify as they don't have a motor.
What the cop probably said: you do not need a motorcycle license ("M") for any motorcycle under 49cc. You can used your standard "G" license.
Most small scooters are 49cc and require plates, insurance and to be licensed. You just need a regular car license to take them out.
