I Was an e-tester too and I got pulled over and showed my emissions badge and told him I do this for a living everyday. Cops wont touch you if you know what your talking about, and in court if I did get a ticket my word is worth more then the cops because I am certified by the government to do it everyday. I think its all in how you present yourself, I mean my exhaust system is loud but my exhaust is off a 60 trim turbo and I need the flow. But I also don't drive it like I stole the car. I shift early and make sure I am driving like I am suppose to be doing, not impressing the girls on the corner on how fast my car can go above the speed limite in that intersection. Now I have gotten a ticket on an old car for a loud muffler and I took it to court and won because the definition in the highway traffic act only states that its only inproper if its not attached or its not working properly. The noise one however does apply though becuase face it I hate it at night when someone come flying down my street at like 2am when I have to work at 8am the next morning and having to listen to how loud he is at the wrong time of night. Anyways thats my experiences with muffler violations.
