Question careless driving ticket?

just wondering:

if a ticket was issued for careless driving and there is something wrong on the ticket, can it be thrown out just like another ticket? Also, it's been like 5 months and he hasn't even heard back from his lawyer yet... is anything going to happen with this?

jw, because my bf got one for touching the centre line ONCE out in the boonies... they tried pinning him for driving under the influence when he had no beer/alcohol in him (he was just stuttering b/c he was nervous ) lol I guess they had to pin something on him since they slapped cuffs on him and dragged him out to a holding cell for 4-5 hours... and not to mention illegally searching his car, and impounding it Made me call a friend to come pick me up!

I don't know if they will just throw it out. Im sure if he went to court and fought it, it will probablly get dropped if they didn't do a test to prove he was under the influence. A buddy of mine got his careless driving ticket dropped when he crashed his car into a pole going a "little" fast, and the cop said that if he went to court the would probablly drop it. So whoknows call one of those ticket fighters or take it to court

he had a breathilizer (sp?) at the station 3-4 hours after they brought him there.... i have no idea how that could be helpful at all i guess they need a quota for tickets or something?

I heard they are now getting 90% of the ticket amount, pretty good motivation to charge people with everything and anything

wtf?

im confused, they thought he was under the influence but they charged him with carless driving? and kept him in a cell for 4-5hrs?
that doesn't make sence... why not dui? did they check his alcohol levels?
and wtf is up with the lawyer for being MIA?
This story sounds like like a block of swiss cheese to me... way too many holes in it.

Actually you are quite wrong. That is why my bf got his too. Long story short my bf worked a 16 hour day (really really hot outside) fell asleep went in the ditch car flipped a good 6 or 7 times, he flew out the sunroof. Later the police officer at the hospital explained that he had to be charged with something due to how bad the accident was and that he wished he could only charge him with "no seat belt" but had to charge him with "careless driving" for crossing the centre line.

^^^forgive me if im wrong, but crossing and touching the center line are 2 different things are they not? take a corner to wide, and ull touch the line...happens to alot on a daily basis im sure...

so, im gonna agree with WRC_Verna and say a cop wouldn't pull u over if u touch the line...now, im sure if u were swerving and what not then you're more likely to get pulled over

look it up under the HTA

Since we haven't actually heard what really happened..... There's not much more to discuss. Officers will *never* go to that extreme for crossing/touching the center line. I'm sure she left out the part where he mouthed off to the cops.

actually no other conditions. look it up.

if you cross the centre line and there is an oncoming car, you can get charged. i don't know if its for careless or not, but you WILL get charged.

Although I don't know your boyfriend... he was most likely rude to the cop to get a ticket like that for something like that. It is entirely possible... but he must have mouthed off... other thing is that they had heard that someone suiting his description was doing something stupid, but they couldn't prove it, so they charged him with what they could while they could see it. AND if they gave him a breathalyzer, they most likely thought he was drunk, or high, etc... and just wanted to get him off the road.

he will most likely recieve a letter in the mail stating he was charged with "unsafe lane change" and pay the $327.50 by w/e date.

i was with him when this happened. We were just driving to his house one night at around 9:30. We were having a pretty good conversation, and i guess we touched the centre line maybe 1-2 times (i know we didn't cross). There was also no one comming from the other direction. my boyfriend is an extremely shy guy and hardly said 2 words to the officers, but i can understand the assumption of some since there are a lot of idiot drivers who confront the police out there.
when we were pulled over, we were doing the limit on the nose so we were wondering what was up. As soon as the the officer came up to the window, the officer's first words after getting his drivers license, etc. were "how much have you had to drink tonight, sir?". We just both looked at each other and he responded with, "i haven't had anything tonight sir" (he was nervous so he was kinda stuttering, i'm assuming they thought he was drunk). It was at night, so the other officer came up and heard what he had said and cut my boyfriend off with "you are lieing, how much have you really had tonight?". My bf just said "look, i'm sorry, but i'm just really nervous, i haven't had anything to drink." The second officer that had come up said "i don't think so, step out of the car, you are under arrest for impaired driving". They put him up against the side of the car and slapped cuffs on him, taking him away to the cruiser.
At that point i'm just sitting in the passenger seat totally dumbstruck, wondering what the hell i'm supposed to do now. The first officer came up to me and told me to step out of the car, so i did. They took their flashlights (both officers were there at that time) and started going through his car, commenting how he had 2 24's of beer (unopened cases) in the back seat and that it looked like it was going to be a party weekend (it was around may 2-4 weekend, and one he picked up for his dad).
After they were done they said i had to call someone to come pick me up, i gave them my information and was told to just sit in the car and wait. They wouldn't give me any other information, and when i asked if he was even going to have a breathalyzer done to prove his innocence the officer just told me they were taking him to the station and he would have one done there.
My friend picked me up and we went over to my bf's house and told his parents what had happened. His mother and sister ran out the door to go to the station and called us at intervals to let us know wtf was happening.
This is where things get kind of fuzzy as i wasn't there myself. Supposedly they got at least 3 different answers from different officers about what was happening. I know my bf had to talk to a lawyer on the phone to read him his rights, or something about what they can and cannot do for sobriety tests.
They ended up charging him with careless driving because they could not charge him with DUI - he had some alcohol show up, but that was from a beer earlier that evening.

Hope this clears some things up.

He already has recieved the ticket, but is taking it to court to fight it, since the entire situation sounds pretty sketchy, as well as a wrong date on the ticket... or something else is wrong on the ticket, i just can't think of it right now.

My bf and his father went to toronto to meet up with his lawyer's assistant like a month after it happened, and the guy said that they would keep in touch... so far, nothing after that has been said.

I'm sorry. i dont mean to sound harsh here, but I think that you bf is not telling you the whole truth. What you are saying makes no sense and sounds way to much like a Hollywod movie.... So the cops had no grounds to arrest your bf, held him with out a charge, and charged him with a bogus made up ticket, is that right??? In other words the cops completely violated your bf's charter rights, detained him without any grounds at a police station and the officer in charge of that station (a staff sergeant or higher) allowed them to do this??? Not only would they have violated his rights but would have committed several criminal offences in doing so (ie; assault, kidnapping, theft, etc), thus jeipardizing their jobs and potentionally facing criminal charges, all over a $365 careless driving ticket????? Come on! I think you or your bf have left out a few details.
