Accident and red light ticket! Help!

So hope you all want to hear my story. I'm on my way home from school and i'm approaching the intersection of Ottawa and Alpine when a driver was turning left, he hesitated and I thought he saw me and then I kept going and on my way through he just starts turning and sees me last second and I smoke him. He drives a Ranger which has some minor damage. My whole left corner is smashed in. Ok now im PISSED. So I got one passanger and so does he and I just stay in my car. We both called the police. Police arrives and I know i'm looking bad, ima teenager with a sports car. I know I got a clean record. So the pasanger of his car gets out and I get out and SHE FLIPPS! Automatically starts excusing me that I ran a FULL RED LIGHT. I tried to keep my calm and then we argued and then the cops split us up and make us pull over. SO now I'm even more mad because the driver didn't even say anything it was the passanger and shes making up this bullshit. We both fill out a report and blah blah blah. The lady cop starts talking to them first and I notice in my mirror some laughing going on and now I feel screwed. So after all of this finally the cop came to the conclusion that we both get Red light tickets! I;m like wtf u didnt even see me go thru one and it was 100% their fault and she told me I have the option of going to court. Now i know im in the whole because she seemed to have believed them more than me. Ive had a clean record and now this happens. Ive had people recomend that I should just pay the ticket and fix it on my own to avoid any more problems because I will lose in court. I hate people like this, can't handle the truth. any advice? Also will my insurance go up becuase of this ticket?

Then who is at fault?

Did you enter the intersection when it was yellow ? If so I'm pretty sure the other driver is at fault because he is only suppose to make a left when it is safe to do so.

Go to court and fight the ticket. Your insurance may or may not go up on renewal.

If your convicted of any offense even being a smaller fine offense your insurance will go up 10-15% on renewal ONLY IF THEY CHECK YOUR DRIVERS ABSTRACT.

My company never checked my abstract upon renewal and their for didn't see the ticket and gave me a good will for being 2 years with a G licence and lowered my insurance 400/year.

If this ends up being you as an at fault, even though I dont think it can be, I would personally beat the shit outta the person who caused the accident and yOu know your not at fault. It would be my revenge as an at fault raises your insurance so much that I'd stop driving period. But don't take this advice.

I don't know what the office said and who was at fault but someone must be at damn fault most likely other driver for improper left turn or something along those lines.

Yes, this person went into my way and yet claims that I RAN A FULL RED. That's what made me angry. I just know he didn't see me. Now I can't afford to fix this, I want to fight it but I feel like I may lose.

it doesnt matter its always the person TURNING! its your word against hers on the red light but the accident shows that she was turning and you were going straight so right of way! simple! and go 2 court 4 the red light. The officer has NO PROOF! so ask 4 a disclosure and beat there ass with it keep asking how do they know and to prove it, they get really pissed but it works! good luck

that cop didn't know how to handle the situation.

They're side of the story wont hold up.
(The passenger of the other car says you ran a full red.. well that would mean they were chilling out in the middle of the intersection on a full red. Doesn't add up)

I'm gonna go with

1. request full disclosure
2. request first attendance meeting
3. dicuss/beg to have the ticket dropped because you are a student
4. show that they are 100% at fault for an improper left turn

^ I got nail with the same ticket when i totalled my corolla

I had a green, they had a green. I know that it was all because he was in a rush and didn't see me. Some have been reccomending to just fight the ticket, win that, and leave it at that and fix my car on my own. It looks like I may lose to them to fight for who is at fault, I mean the cop was just having a good time with them! We each have a witness aswell which was the passanger.

^^^ understandable but you fail to understand that they never had a right of way in any case. so if anyones to blame it would be them. now lets say the light was yellow or red, you both should get the red light ticket. yet the cop has no proof unless you stated you ran the red light. fight it and you'll win as nothing the passenger says adds up.

mx6crazy........oh man if you entered when green your 100% not at fault. THEIR INSURNACE company or even urs should pay for damage's. Your insurance shoudl not rise.

YOu shoudl win that ticket in court no problems. If you can bring YOUR passenger as a witness. If thats even allowed.

IF you can't get compensation for fixing your car without an insurnace hike go beat the livign shit outta the person that did this to you or at least smash their car with a baseball bat in the amount of equivalent damage done to your car. (This is my anger side talking).

But I dont think your gonan need to end up doing this. This shoudl be an easy day in court for you and your insurnace should not rise.

^ Don't listen to his angry side, that will just end up in u getting charged with vandalism if you're caught. anyhow, Don't stress about it, the odds of him getting screwed on this are 100% better then u, if what you're saying is all true.

You were legally travelling straight with the right of way, and he made an illegal turn into the path of oncoming traffic. He should have been charged with that at the scene, regardless of red light or not.

The Officer shouldn't have given either of you red light tickets really, as she didn't witness it... I don't think that ticket will hold up in court.

Again, I havent successfully won an 'improper left turn' argument before, so it's all logic and assumption on my part

Yup looks like I will be taking it to court. I contacted traffic violations solutions if anybody has heard about it, they win or its free and he feels CONFIDENT. My insurance told me once I win in court then to make the claim, remember i got no collision so to get it fixed they got to make it their fault. Well see what happens!

Make sure you look into that carefully. A reduced fine is considered a win to most places.


The other thing to consider....the reason the cop may have given you both a red light ticket is to determine who is at fault. The only way to back up her claim is for them to take the ticket for running the light and admit to running a red light, which would make them at fault OR fight it and proving themselves to be liars and that the light wasn't red, and they pulled out in front of you.......

Actually, you know what. If the other driver was in the intersection and he is turning left it's ok for him to turn left on the yellow (if it's clear, which obviously it wasn't). So that leaves him at fault on that part BUT by the sounds of this thread you went through (at least) a yellow light. That's a fine right there. Proceeding before Green. I got the same ticket almost 2 years ago but with a different scenerio. That part would be your fault.

Was this in a busy part of Kitchener? If it is it'd be harder to prove that you couldn't stop (because you were going to fast).

Sucks about the accident though, hopefully everything works out for you though.
